By accessing this website, requesting an estimate, scheduling services, purchasing products, or engaging Fireside Escapes LLC ("Company"), the customer agrees to the following Terms and Conditions.
Scope of Services
Fireside Escapes LLC provides fireplace repair, fireplace inspections, gas log installation, chimney-related services, dryer vent cleaning, gas appliance diagnostics, maintenance, and related services.
Services are limited solely to the work specifically described in the approved estimate, invoice, work order, or proposal. No inspection, certification, guarantee, or evaluation of any component shall be implied beyond the approved scope of work.
Hidden Conditions
Fireplaces, chimneys, venting systems, gas piping, combustion systems, framing, masonry, electrical systems, and related components may contain hidden defects not visible during routine inspection or service.
Fireside Escapes LLC shall not be responsible for hidden, concealed, inaccessible, latent, or pre-existing conditions that are not reasonably discoverable during the course of service.
Customer Responsibility
Customer is responsible for providing safe and reasonable access to the property and work area.
Customer acknowledges that operation of any fireplace, chimney, venting system, gas appliance, or related component after service remains the responsibility of the property owner or occupant.
Estimates
All estimates are based upon visible conditions at the time of inspection.
Additional labor, materials, repairs, code deficiencies, safety concerns, or hidden conditions discovered during service may require additional charges beyond the original estimate.
Estimates are not guarantees of final cost.
Special Order Materials
Special-order parts, gas logs, fireplace components, custom glass doors, remote controls, fireplace accessories, and non-stock materials are non-refundable once ordered.
Deposits collected for special-order materials are non-refundable.
Payment Terms
Payment is due immediately upon completion of services unless otherwise agreed in writing.
Unpaid balances may be subject to collection costs, attorney fees, court costs, interest, and other lawful recovery expenses.
Scheduling and Cancellations
Appointment times are estimated and not guaranteed.
Fireside Escapes LLC reserves the right to reschedule appointments due to weather, safety concerns, emergencies, supplier delays, equipment failures, or circumstances beyond its control.
Appointments cancelled with less than 24 hours notice may be subject to a cancellation fee.
Missed appointments or appointments where access cannot be provided may result in a trip charge.
Warranty Disclaimer
Manufacturer warranties apply only to products covered by the manufacturer.
Except as expressly provided in writing, Fireside Escapes LLC makes no warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, future performance, code compliance, safety certification, or uninterrupted operation.
Limitation of Liability
To the fullest extent permitted by Texas law, Fireside Escapes LLC shall not be liable for indirect, incidental, consequential, special, exemplary, punitive, or economic damages, including but not limited to loss of use, loss of property value, loss of income, business interruption, fire damage, smoke damage, carbon monoxide exposure, water damage, personal injury, or death arising from:
- Pre-existing conditions
- Hidden defects
- Customer misuse
- Manufacturer defects
- Normal wear and tear
- Improper prior installations
- Structural deficiencies
- Code violations
- Conditions outside the approved scope of work
In all cases, the maximum liability of Fireside Escapes LLC shall not exceed the amount actually paid by the customer for the specific service giving rise to the claim.
Indemnification
Customer agrees to defend, indemnify, and hold harmless Fireside Escapes LLC, its owners, employees, agents, contractors, and representatives from any claims, damages, losses, liabilities, expenses, attorney fees, or costs arising from customer negligence, misuse, unauthorized modifications, failure to follow recommendations, or continued operation of equipment after safety concerns have been identified.
