Important Safety Notice
Fireplaces, chimneys, venting systems, gas piping, gas appliances, gas log sets, combustion systems, fireplace inserts, and related components involve fire, heat, combustion gases, carbon monoxide, electricity, and fuel systems that may present significant safety hazards if improperly installed, maintained, operated, modified, or repaired.
Improper operation or defective conditions may result in fire, explosion, carbon monoxide exposure, smoke damage, property damage, serious bodily injury, or death.
Limited Scope of Service
Services performed by Fireside Escapes LLC are limited solely to the scope of work specifically described in the approved estimate, invoice, work order, inspection report, or service agreement.
No service, repair, inspection, cleaning, diagnosis, installation, recommendation, conversation, estimate, photograph, report, or invoice shall be interpreted as a certification, warranty, guarantee, or representation that any fireplace, chimney, venting system, gas appliance, structure, or component is free from defects, safe for operation, code compliant, or suitable for continued use.
Hidden and Inaccessible Conditions
Many fireplace, chimney, venting, gas, structural, and combustion-related defects may be concealed within walls, ceilings, attics, crawlspaces, chases, masonry structures, framing systems, venting systems, or inaccessible areas.
Fireside Escapes LLC shall not be responsible for hidden, latent, inaccessible, concealed, pre-existing, or subsequently developing conditions that are not reasonably discoverable during the course of service.
Customer Responsibility
The property owner and occupant remain solely responsible for the operation, maintenance, monitoring, inspection, and safe use of all fireplaces, chimneys, venting systems, gas appliances, gas piping, and related equipment before, during, and after service.
Customers are responsible for discontinuing operation of any appliance or system that appears unsafe, malfunctions, emits unusual odors, produces excessive soot, leaks water, leaks gas, or exhibits abnormal operation.
Recommendations and Declined Repairs
If Fireside Escapes LLC identifies safety concerns, damaged components, code deficiencies, venting issues, gas leaks, combustion concerns, deterioration, improper installations, clearance violations, or other conditions requiring correction, and the customer declines recommended repairs or corrective actions, the customer assumes all risks associated with continued operation.
The customer agrees to release, defend, indemnify, and hold harmless Fireside Escapes LLC from any claims, damages, injuries, losses, liabilities, attorney fees, costs, or expenses arising from conditions that were identified, disclosed, recommended for correction, or otherwise declined by the customer.
No Warranty of Future Performance
Fireplaces, gas appliances, venting systems, chimney systems, ignition components, controls, electronics, valves, thermopiles, thermocouples, pilot assemblies, blowers, and related components may fail at any time due to age, wear, environmental conditions, manufacturer defects, improper installation, improper maintenance, power fluctuations, gas supply issues, or other factors.
Fireside Escapes LLC makes no guarantee regarding future performance, service life, reliability, efficiency, safety, code compliance, or continued operation of any system or component unless specifically stated in a separate written warranty.
Limitation of Liability
To the fullest extent permitted by Texas law, Fireside Escapes LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or economic damages, including but not limited to:
- Fire damage
- Smoke damage
- Carbon monoxide exposure
- Gas leaks
- Water intrusion
- Property damage
- Loss of use
- Loss of income
- Business interruption
- Personal injury
- Death
arising from:
- Pre-existing conditions
- Hidden defects
- Structural deficiencies
- Code violations
- Manufacturer defects
- Improper prior installations
- Customer misuse
- Failure to maintain equipment
- Declined recommendations
- Conditions outside the approved scope of work
Under no circumstances shall the liability of Fireside Escapes LLC exceed the amount actually paid by the customer for the specific service giving rise to the claim.
Acceptance
By accessing this website, requesting services, approving estimates, scheduling appointments, purchasing products, making payments, or allowing work to proceed, the customer acknowledges that they have read, understood, and agreed to this Safety & Liability Disclaimer.
